Busy Beas Bookkeeping Pty Ltd trading as Balance With Kel (ABN 57 619 961 910) (‘we’, ‘us’, ‘our’), cares about your privacy and is committed to protecting your personal information in accordance with this Privacy Policy, the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

This Policy sets out the type of information that we may collect about you, the purposes for which we collect it and how we will hold, use and may disclose your personal information.

What is personal information?

‘Personal information’ is information or an opinion about an identified individual, or an individual who is reasonably identifiable.

Your personal information

We may collect and hold personal information about you during the course of conducting our business, such as:

  • your name, age and date of birth;
  • your contact information, including telephone number, email address and residential address;
  • contact information for your emergency contact;
  • debit / credit card information, bank details and payment history;
  • your image, if you are photographed in one of our classes; and
  • health information about any medical conditions that may affect your ability to participate in our classes.

The type of personal information we collect and hold about you will vary depending on the nature and purpose of our relationship.

We will only collect and store personal information that is reasonably necessary for us to provide you with the service that you are interested in. 

How we collect personal information

Your personal information will be collected by us through the Balance With Kel website located at https://www.balancewithkel.com (‘Website’) or otherwise through our dealings with you.

We may collect personal information that you provide to us orally, or in writing. For example, we may collect your information:

  • when you complete an enrolment form or register for our classes;
  • when you contact us with an enquiry through the Website or by email;
  • when you participate in our classes (in person or online);
  • when you subscribe to our articles or newsletters through the Website; or
  • when you fill out a survey or other form with your personal information included.

We may wish to take photographs of people in our classes to place on our social media accounts from time to time.  We will only do this if you agree to it at the time.

If you participate in an online class, you are welcome to do so without putting your video on.  This will mean that the instructor and other participants will not be able to see you doing the poses or exercises, and will mean that the instructor is not able to provide you with individualised comments on your practice. 

It is important that the information we hold about you is accurate, complete and up to date. If you believe the personal information which we hold about you has changed, for example, if there are changes to your contact information, please contact Kel at info@balancewithkel.com.

If the personal information you provide to us is inaccurate, or if you choose not to provide us with certain personal information, we may not be able to provide our services to you, contact you, give you access to information you have requested or otherwise provide you with the service or response you seek.

We will not collect personal information about you from any third parties unless you request it or otherwise with your consent. For example you may ask your health care practitioner to provide us with information about your health to assist us in tailoring a class to be suitable for you.

Use and disclosure of personal information

We will only use your personal information for the purposes for which it is given to us, or for a purpose related to our functions or activities, unless otherwise required or authorised by law.

For example, we will use your personal information for the following purposes:

  • to tailor your classes for any health conditions that you have notified the instructor about;
  • to communicate with you and manage our relationship with you, including to remind you of upcoming classes or to check-in with you if you have missed classes;
  • to conduct our business, such as to collect payments;
  • to facilitate our internal business operations, such as for internal marketing analysis and update our social media with photographs of our classes;
  • to comply with our legal obligations; and
  • to help us manage and enhance our services.

We will not use or disclose your personal information to any third party unless:

  • you request it, for example, if you ask us to provide information about your exercise regime to your health care practitioner;
  • you consent to the use or disclosure; or
  • it is required or authorised by law.

Direct marketing

We may use your personal information to provide you with promotional materials or information about our classes, or other goods or services that may be of interest to you. If you do not wish to receive this type of contact from us, please use the ‘opt out’ option we provide to you in our email or SMS. 

Cross border disclosure

We use Mailchimp to store your emails and telephone numbers and to provide our email marketing services to you, with servers hosted in the United States.  Mailchimp’s Privacy Statement is available here: https://www.intuit.com/privacy/statement/.

Otherwise, we do not routinely transfer any personal information overseas. We will not transfer any of your personal information outside of Australia unless we have your consent or it is required or authorised by .

Consent

By providing your personal information to us you agree to the collection, use, disclosure and storage of that information by us as outlined in this Privacy Policy.

Security

We may hold your personal information in different ways, including in hard copy or electronic form. We have measures in place to ensure that any personal information we hold is secure and protected from misuse, loss, fraudulent activity and unauthorised disclosure.

We take reasonable steps to protect all personal information that we hold from misuse or unauthorised .

Cookies and other information

We may collect certain information from visitors who access the Website including dates and time of access, IP addresses, browser type, operating system and domain names.

We also may collect information via analytics software that can track use of the Website. This analytic information can include navigation through the Website, number of visits, duration of the visit and the areas of the Website commonly used. It does not contain any personal information about the visitor. We may use this information to improve performance of the Website. You can opt out of the collection of this analytic information.

We collect information in the form of ‘cookies’ through the Website. Cookies are pieces of information that websites send to the browser and are stored in the computer hard-drive. Cookies are designed to make using the Website easier by storing information about your preferences on the Website.

We’ll only keep your information for as long as we require it to provide services to you and for related purposes. We’re required to keep some of your information for certain periods of time under applicable law. When we no longer require your information for any purpose, we’ll ensure that your information is destroyed or de-identified.

What if you contact us via social media?

You may contact us and send us messages using social media (such as Facebook).  Those social media are operated and controlled by third parties, and we are not responsible for their operation.  You should refer to the privacy policy and other information provided by those third parties regarding the use of their facilities.

All reasonable efforts to address a complaint and achieve an effective resolution will be made within 30 working days or as soon as practicable.
